In Russia will toughen penalties for release to the line of vehicles

The issue of defective cars on the line will be “more expensive” both legal entities and officials

As follows from the draft law federalnogo placed on the portal of projects of normative legal acts (LINK), the developer of the project is the Ministry of transport has decided to toughen the punishment issue on the line the faulty vehicles, “with the faults under which operation is prohibited, in violation of the requirements on conducting pre-trip or pre-shift inspection of the technical condition of vehicles, vehicles not registered in the established order that has not passed technical inspection, with obviously false state registration signs,” reads the text of the draft law.

The draft law notes that the tightening of article 12.31 of the administrative code: “the release to the line of vehicle faults under which operation is prohibited and in violation of the requirements on conducting pre-trip or pre-shift inspection of the technical condition of vehicles or a violation of the order of its holding, except in the cases prescribed by parts 2 and 3 of this article

punishable by an administrative fine on the controller of the technical condition of motor vehicles or the controller of the technical condition of vehicles of city land electric transport in the amount of five thousand roubles; on juridical persons – thirty thousand roubles“.

Thus, for legal entities significantly increases liability for faulty transport, which is available on line.

The second important point of the fines, the transport Ministry introduces a draft “release to the line of vehicles with faulty brake system (except brake), steering or coupling device (in a train), as the vehicle design changes without authorization”. For officials, which must control these incidents is introduced a fine of ten thousand roubles; on legal entities even more – fifty thousand roubles.

Recall that in the current version of the administrative code, responsibility for legal entities is stipulated not.

Touched legislators and issue the vehicle with established on it without the corresponding permission devices for giving special light or sound signals, as well as with illegally deposited on its outer surface special color schemes of cars of operative services etc.

For this fine to the controller of the technical condition of motor vehicles or the controller of the technical condition of vehicles of urban land electrical transportation will be imposed in the amount of twenty thousand roubles; on juridical persons – fifty thousand roubles.

For officials and legal entities, nothing changes.

In addition to the aforementioned tightening of penalties, liability for the release of the line is not registered or has not passed technical inspection will rise from five to ten thousand rubles for officials and fifty thousand rubles for legal entities. And also, set the vehicle with obviously false state registration signs – attracts imposing of the administrative penalty on the officer responsible for the technical condition and operation of vehicles, in the amount of twenty thousand roubles; on juridical persons – fifty thousand roubles.

And finally, the most severe new from the whole range of severity proposed by the project for the re-release of transport with faulty brakes:

punishable by an administrative fine referred to in this article officials in the amount from thirty thousand to fifty thousand roubles or disqualification for the term from one year till three years; on legal entities – an administrative fine in the amount from hundred thousand to three hundred thousand rubles or administrative suspension of activity for a period from thirty days to ninety days.

Needless to say that the suspension of activities of a transport enterprise to three months could destroy it. Therefore, persistent offenders should be afraid of the new project, which will soon become law. Also recall that in accordance with the applicable article of the administrative code for administrative offences provided for by this article, persons engaged in entrepreneurial activities without forming a legal person, bear administrative responsibility as legal entities.

By the way, Federal law shall enter into force one year from the date of its official publication.
